A man who tragically lost both of his legs in a serious vehicle crash is suing ride-share program Uber, as well as the driver who apparently hit him. The 23-year-old California man was struck by a vehicle after assisting his Uber driver in moving his stalled vehicle off the road. It is unclear at this time whether the other driver involved in the car accident will face criminal charges in addition to the civil suit filed by the victim.
According to the lawsuit, the man was riding in an Uber vehicle on March 7 when the vehicle ran out of gasoline. The driver attempted to coast onto the shoulder, but the car came to rest in a freeway lane. When both men exited the vehicle to push it off to the side of the road, another driver lost control and struck the passenger. The force of the impact destroyed his legs, both of which had to be amputated.
The man and his representation have filed lawsuits against Uber, the driver in question, Uber’s insurance carrier, a vehicle rental company and the driver who allegedly hit him. The suit was filed in a Los Angeles Superior Court. In the meantime, the man’s family has raised over $100,000 through GoFundMe to help cover his medical expenses.
Obviously, this car accident could have resulted in further tragedy, but the loss of one’s legs is a monumental change of life to address. This is why, regardless of whether the second driver is charged criminally, it is the victim’s right under California law to file personal injury suits against all parties to which the crash can be attributed. The man’s legal representation will argue in favor of financial damages being awarded to the man and his family for his continued rehabilitation and care.
