Scars and Disfigurement from Motorcycle Accidents
Scars and other disfiguring injuries are common results of motorcycle accidents. Even with protective clothing and approved motorcycle helmets, you are vulnerable to lacerations, burns, and road rash that can cause permanent scarring and disfigurement. Significant scarring, in turn, can lead to a loss of self-esteem and cost thousands of dollars to correct with reparative or cosmetic surgery. Some scars can even limit your ability to work in certain professions.
At Scott J. Corwin, A Professional Law Corporation, we aggressively pursue compensation on behalf of people who have significant scars and/or disfigurement because of motorcycle accidents. Led by Attorney Scott J. Corwin, our firm has successfully represented more than 3,000 clients, recovering over $125 million in compensation on their behalf.
What Is Road Rash?
Road rash is technically a type of burn known as a friction burn. This injury occurs when the skin is forcefully scraped over an abrasive surface, such as asphalt. This leads to a combination of heat burns (caused by friction) and open wounds (abrasions) on the skin. Friction burns are commonly referred to as “road rash” because they are very common in motor vehicle accidents, particularly bicycle and motorcycle accidents in which victims are often ejected from their vehicles.
Road rash can range from relatively mild to severe and most commonly occurs on arms, elbows, knees, shins, and ankles. Although many motorcyclists wear heavy, protective clothing, gloves, boots, and other gear to reduce the risk of road rash, these protections are not always sufficient in preventing serious injury.
Like other types of burn injuries, friction burns are categorized according to severity:
- First-Degree Abrasions: First-degree abrasions are considered “mild” injuries and generally only affect the upper layer of skin (epidermis). First-degree abrasions do not bleed and can typically be effectively treated at home.
- Second-Degree Abrasions: Second-degree abrasions are classified as “moderate” injuries. They may involve damage to the upper and lower layers of skin (epidermis and dermis, respectively). Second-degree abrasions may result in mild bleeding.
- Third-Degree Abrasions: Third-degree abrasions are severe injuries. Also known as “avulsion wounds,” third-degree abrasions typically involve significant tearing of the skin and damage to deeper tissues, as well as considerable bleeding.
Moderate to severe road rash requires immediate medical attention, especially when abrasions cover large areas of the body or occur on the hands or face. Without adequate medical intervention, road rash can lead to serious complications, including potentially life-threatening infections. Even with proper treatment, these injuries can cause significant and/or permanent scarring and disfigurement.
Compensation for Motorcycle Accident-Related Scarring and Disfigurement
After a serious motorcycle accident, victims with significant scarring and/or disfigurement are likely to face numerous physical, emotional, and financial challenges. From getting proper medical treatment to taking time off work to heal to dealing with the lasting trauma of the accident, the road to recovery can be long and difficult.
At Scott J. Corwin, A Professional Law Corporation, we believe that you deserve justice. If someone else was to blame for the collision, reach out to our Los Angeles motorcycle accident scarring and disfigurement attorney to learn more about your right to fair compensation. Although a settlement or verdict cannot undo the pain and suffering you have endured, fair financial compensation can provide the resources you need to heal and move forward with your life.
Depending on the specific details of your case, you could be entitled to compensation for the following damages:
- Emergency care costs, including ambulance and/or hospital fees
- Surgery, including cosmetic surgery, and other treatments
- Pain management, including prescription medications
- Cost of medical devices and/or medical equipment
- Ongoing and future medical care costs
- Lost income, wages, and other employment benefits
- Diminished earning ability and lost future earnings
- Pain and suffering, including physical pain and emotional trauma
- Miscellaneous out-of-pocket expenses, such as in-home medical care
In some instances, victims of motorcycle accidents may be entitled to punitive damages in addition to compensatory damages. Punitive damages are rare; they are intended to punish the liable party for egregious negligence and/or willful misconduct, including intentional infliction of injury. If you were injured by a drunk driver or someone who was engaged in excessively negligent or wrongful conduct, you could be entitled to seek both compensatory and punitive damages.
